Is a Trust Right for Me?

A trust is a legal document capable of holding and transferring property to beneficiaries. There are generally three entities involved in the administration of a trust: The grantor, the trustee, and the beneficiary. The grantor is the owner of the property, the trustee is the manager of the trust, and the beneficiary is the individual to which the assets are assigned.

There are a number of trusts available to meet the varying needs of those who use them. At Schwab & Radcliffe, P.C., we inform clients of the following types of trusts, and assist them in choosing the option that best meets their needs:

  • Living trusts are created while the grantor is living. The two types of living trusts are:
    • Revocable trusts can be altered or modified during the life of the grantor.
    • Irrevocable trusts cannot be altered.
  • Testamentary trusts are drafted upon an individual's death, based on the information contained in the will.
  • Irrevocable Life Insurance trusts are drafted to convey life insurance policy benefits to loved ones while "gifting" the annual premium payments.
